Terms & Conditions for the Supply of Goods
- Definitions & Interpretation
- Within the context of this policy, the following words and phrases shall be interpreted thusly:
- “Condition” means any one or more of these Terms and Conditions.
- “Goods” means the goods described in the purchase or listing of sale.
- “Parties” means the Buyer (sometimes, the “Client” or “Customer”) and the Seller (Britannia Arts).
- “Price” means the agreed sum of money given in exchange for the goods.
- The headings in these Terms and Conditions are for ease of reference only and shall not affect the interpretation or construction of these Terms and Conditions.
- Where the context permits, the use of the singular shall be construed to include the plural, and the use of plural the singular, and the use of any gender shall include all genders.
- General
- These Terms and Conditions together with the relevant purchase shall constitute the contract between the Parties for the supply of the Goods (the “Contract”).
- The Contract constitutes the entire agreement between the Parties relating to the supply of the Goods and replaces all previous negotiations, agreements, understandings and representations, whether oral or in writing. However, nothing in the Contract shall limit or exclude any liability for fraud.
- The Goods
3.1 The Supplier shall supply the Goods in accordance with the terms set out herein.
3.2 The Goods shall:
- Be to the reasonable satisfaction of the Buyer.
- Be fit and sufficient for all purposes for which such Goods are generally used and / or otherwise consumed. However, the Seller only assumes this duty for the duration the Goods are within their care and custody. Any lapses in quality occurring during transit are not considered the fault of the Seller and thusly invoke the Returns policy should the Buyer elect to do so.
- Be of the same quality and description as any sample or listing provided.
3.3 All descriptions are to our knowledge fairly and accurately written, and all reasonable investigation is made to ensure all items are as stated upon sale. Unless otherwise stated, the description and grade is a true representation of the item for offer.
3.4 Where it is difficult to authenticate an item fully as original, any term such as “original” or “genuine” or “authentic” or “Official” will not be used in its description and will be offered on an “As is” or “Sold as seen” basis, Unless we specifically state an item to be original, we are not offering it as original and do not guarantee it to be as such.
3.5 Returns and refunds are available within line with your consumer rights and our returns policy.
- Delivery
4.1 The Seller shall arrange delivery of the Goods to the address stated by the Buyer during the Purchase.
4.2 The Seller shall arrange delivery of the Goods via a registered postal / courier service and provide tracking reference details to ensure optimal security and peace of mind during the transit stage of the transaction.
- Property and Risk
5.1 Without prejudice to the Buyer’s other rights and remedies under this Contract, property and risk in the Goods shall pass to the Buyer on acceptance of delivery.
- Damage to Goods in Transit
6.1 Any consignment of Goods dispatched by the Seller to the Buyer shall be accompanied by a delivery note prepared by the Seller marked with details unique to the specific transaction(s).
6.2 Where some or all Goods have been damaged in transit (or have failed to arrive at the Buyer after dispatch by the Seller) the Seller shall issue a refund in accordance with the refund policy as stated on the website provided the relevant tracking information has been quoted and that the postal / courier service used has been informed.
7. Payment
7.1 In consideration of the supply and delivery of the stated Goods by the Seller, the Buyer henceforth agrees to pay the Seller the quoted Price in GBP (£).
7.2 Payment for Goods is required prior to dispatch. Should the Buyer wish to return any purchased items, they can elect to do so as per the Seller’s Returns Policy.
7.3 Britannia Art does not take liability for cost incurred if payments are not sent in accordance to the site terms or instructions.
8. Rights of Third Parties
8.1 This Contract shall not create any rights that are enforceable by anyone other than the Parties herein.
9. Disputes and Mediation
9.1 Before resorting to litigation, the Parties herein shall attempt in good faith to negotiate a settlement to any dispute between them arising out of or in connection with this Contract.
9.2 In the first instance, the Buyer is invited to contact the Seller in writing, clearly stating their grievance and, where possible, outlining what steps or resolution they would like to see. The Seller would then have 10 working days from receipt of said communication, to issue a response.
9.3 If the parties are unable to resolve the dispute, then either party may elect to refer the matter to mediation by a neutral advisor or mediator (“the Mediator”).
9.4 If the Parties are unable to agree on a Mediator within 10 working days of the request having been made by one party then an application will be made to the Centre for Dispute Resolution (“CEDR”) to appoint a Mediator.
9.5 The parties shall seek to agree directions for how the mediation is conducted and, failing agreement, they shall seek directions from the Mediator.
9.6 If the Parties reach agreement on the resolution of their dispute the agreement shall be made written and considered binding thereafter.
10. Governing Law
10.1 Unless otherwise explicitly stated and agreed beforehand, any Contract between the Buyer and the Seller shall be governed by and construed in accordance with the law of England and Wales and shall therefore by subject to the exclusive jurisdiction of the courts of England and Wales.
11. Money laundering regulations
11.1 Under Money laundering regulations within the United kingdom, We will carry out customer due diligence when a customer orders more than £10,000 in one or multiple orders, We will hold any order until the customer can provide copies of address and ID information.
11.2 We will accept Utility Bills such as Electric, Gas or Bank statements as proof of address, and Passport or Photo driving licence as Proof of identity.
11.3 We will keep these documents on file securely for 6 years and only share them with interested authorities upon official request. Please note this is rare.

12. Misc
12.1 We reserve the right to retain use of images of products after sale for promotional and other commercial use later. You are also welcome to use images of items you have purchased under personal licence as long as our images are not used for commercial gain.
